Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the website www.pristinefiltration.com.au (the “Site”) and any purchases made through the Site. The Site is owned and operated by Freedom Legacy Pty Ltd (ABN [insert ABN]) trading as Pristine Filtration (“Pristine Filtration”, “we”, “our”, “us”).
By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy and Refunds, Returns & Warranty Policy. If you do not agree, you must not use this Site.
1. Definitions
“Customer”, “you”, “your” means any person accessing the Site or purchasing products from us.
“Products” means water filtration systems, accessories, and related items supplied by Pristine Filtration.
“Finance Providers” means third-party finance partners including, but not limited to, Zip Pay and Brighte.
“Installer” means a licensed plumber or tradesperson engaged by you to install Products.
2. Eligibility & Customer Responsibilities
You must be at least 18 years of age and capable of entering into legally binding contracts to purchase from us.
You must provide accurate, complete, and current information when placing an order.
You are responsible for engaging a licensed plumber to install any water filtration system supplied by us.
You are responsible for maintaining Products in accordance with manufacturer recommendations.
3. Orders, Pricing & Payment
All prices are listed in Australian dollars (AUD) and are inclusive of GST unless otherwise stated.
We reserve the right to correct pricing errors, product descriptions, or availability without prior notice.
Orders are subject to acceptance by us. We may decline or cancel an order if Products are unavailable, there is a pricing error, or for any other reasonable reason.
Payment must be made in full at the time of purchase unless a finance option is selected.
Finance purchases are subject to approval and terms set by the relevant Finance Provider.
4. Delivery & Risk
If we arrange delivery, risk in the Products passes to you when the Products are delivered to your nominated address.
If you arrange your own courier or collection, risk passes to you once the Products leave our warehouse or supplier.
Delivery timeframes are estimates only. We are not liable for delays outside our reasonable control.
5. Warranties & Consumer Guarantees
All Products are supplied with guarantees that cannot be excluded under the Australian Consumer Law (ACL).
In addition, our Products are covered by a 2 years manufacturing warranty against defects in materials or workmanship, subject to the exclusions outlined in our Refunds, Returns & Warranty Policy.
This warranty does not cover consumables (filters, seals, O-rings), normal wear and tear, surface rust, scratches, powder coating damage, misuse, neglect, or damage caused by improper installation or maintenance.
6. Returns & Refunds
Returns and refunds are handled in accordance with our Refunds, Returns & Warranty Policy, available on our Site.
We do not accept returns for change of mind.
Claims must be made within a reasonable time and accompanied by proof of purchase.
7. Installation & Installer Liability
Pristine Filtration supplies Products on a supply-only basis unless otherwise agreed in writing.
All installations must be carried out by a qualified, licensed plumber in accordance with manufacturer guidelines.
Any damage caused during installation, or issues arising from incorrect installation, are the sole responsibility of the Installer and will not be covered by our warranty.
We are not liable for any property damage, water damage, or consequential loss caused by faulty or negligent installation.
8. Finance Terms
If you choose to pay via Zip Pay, Brighte, or another Finance Provider, you acknowledge that your finance contract is directly with that provider.
We are not responsible for approval decisions, account management, repayment schedules, or disputes with Finance Providers.
Refunds for Products purchased through finance will be processed back through the original finance account in line with the provider’s terms.
9. Intellectual Property
All content on this Site, including text, images, graphics, logos, product descriptions, design, and downloadable material, is the property of Freedom Legacy Pty Ltd or its licensors. You must not copy, reproduce, modify, or distribute any content without prior written consent.
10. Limitation of Liability
To the fullest extent permitted by law:
We are not liable for indirect, incidental, special, or consequential loss or damage, including property damage, water damage, loss of profits, or personal injury, arising out of the use, installation, or inability to use our Products.
Our liability for any breach of a consumer guarantee under the ACL is limited, at our option, to the repair, replacement, or refund of the Product.
Nothing in these Terms excludes or limits your rights under the ACL.
11. Indemnity
You agree to indemnify and hold harmless Freedom Legacy Pty Ltd, its directors, officers, employees, agents, and affiliates from any claims, losses, damages, or expenses (including legal costs) arising from your breach of these Terms, misuse of Products, or reliance on an unlicensed Installer.
12. Privacy
Your use of the Site and our handling of your personal information is governed by our Privacy Policy, available on our Site.
13. Governing Law
These Terms are governed by the laws of the State of Queensland, Australia. You submit to the exclusive jurisdiction of the courts in Queensland.
14. Severability
If any part of these Terms is found to be invalid or unenforceable, that part will be severed, and the remainder will continue in full force and effect.
15. Changes to These Terms
We may update or amend these Terms from time to time. Updates will be effective when posted on this page. Continued use of the Site after changes are published constitutes acceptance of the revised Terms.
16. Entire Agreement
These Terms, together with our Privacy Policy and Refunds, Returns & Warranty Policy, constitute the entire agreement between you and Pristine Filtration and supersede any prior understandings or agreements.
